ANSE complaint that the Autonomous Agricultural Perich favors allowing destroy the coast (11/10/2011)

The Southeastern Association of Naturalists has lodged an appeal against the decision of the Director General of Ports and Transport, José María Bernabé Thomas fails to understand that Coastal Regulation, favoring agricultural interests Perich against the protection of the public maritime domain Terrestrial.

The resolution authorizes the execution of large cuts and fills in the servitude of protection, despite having an unfavorable report from the Coasts in Murcia and the Directorate General of Environment has requested the restoration of the area.

In the past month of July, the Southeast Association of Naturalists (ANSE) reported the breaking of a front of more than 1.2 km coastline and more than 50 hectares in Canada Gallego (Mazarrón).

Then, the association reported the condition of protected plant species, destruction of habitats of Community interest and affection the Maritime Terrestrial Public Domain and protective easements.

This was authorized clearing the former Director General of Natural Heritage and Biodiversity based on the exception provided for in Article 40 of the Forest Act.

Similarly, the Department of Nature Protection of the Civil Guard, Coasts in Murcia, environmental agents and the Hydrographic Confederation of Segura reported several irregularities (earthworks, protected species condition, condition of DPMT and easements, condition to area police channels, etc.) about the actions of Perich agreeing with the complaints of ANSE.

For its part, Murcia Coasts (Ministry of Environment, Rural and Marine Affairs) unfavorable report Perich's proposal to install greenhouses in bondage DPMT protection, since it would carry out slopes and embankments of 3 - 5 meters (even more in some points) that would have a considerable impact on DPMT.

Costa Regulation allows exceptionally higher than 3 meters slopes after evaluation of its necessity and its impact on the maritime-terrestrial public domain and the bonded zone of protection.

In addition, the current Director General of Environment of the Autonomous Community, Teresa Navarro, in July 2011 sent a report to the Directorate General of Ports and Transport advising that the permit issued by the former Director General of Natural Heritage and Biodiversity was not applicable servitude DPMT protection and, therefore, had affected the easement without permission.

It also requested the Agricultural DGPyT Perich obliging the restoration of the first 100-150 meters of coastline.

However, the Director General of Ports and Transport, José María Bernabé Thomas, has been deaf to the adverse report of the Coasts in Murcia and has concealed the existence of the second report of the Directorate General of Environment, and without prior assessment the impact on DPMT authorized earthworks and installation of greenhouses in front of the coast without making a single additional condition to Agricultural Perich.

Similarly, the resolution is in contradiction with the report of the Directorate General of Environment because it believes that the change of use of protective easement is not subject to authorization by the DGPyT.

ANSE believes that the resolution of the Director General of Ports and Transport in breach of Articles 46 and 48 of the Rules of Costas, and therefore has lodged an appeal to the Director of Public Works and Planning, Sevilla Antonio Recio, requesting the annulment resolution and the opening of disciplinary proceedings against Agricultural Perich.

The Association claims that the autonomous region has turned to two exceptional (one under the Forest Act and another under the Coastal Regulation) without justification or evaluation to promote agricultural interests against the protection Perich Public Domain.
