Yesterday was known the decision of the TSJ to estimate the appeal filed by the State Coastal Demarcation that was opposed to the installation of greenhouses on the coast Mazarron by Perichan.
The ruling gives the reason to ANSE, which asked the Autonomous Community to revoke the authorization.
Now, the Association calls for the restoration of the destroyed coastline
Since 2011, ANSE has been denouncing any irregularities around greenhouse flushing by the Perichan agricultural company on the coast of Mazarrón.
As early as July 2011, the Association requested explanations from the Environment DG for the authorization of clearings that affected numerous protected species on the coast of Mazarrón, as well as the public domain and the easement of protection.
Following the ANSE complaints, a number of investigations were launched.
On the one hand, the demarcation of Costas in the Region of Murcia initiated a procedure for sanctioning the affection to the Public Domain Terrestrial Maritime.
For its part, the prosecution initiated proceedings for a possible crime against protected species that ended in the court of Totana.
The inquiries carried out by ANSE showed that the removals were not authorized by the General Directorate of Ports and Coasts of the Autonomous Community to affect the easement of protection.
The situation of irregularity of the works forced the Director General of the Natural Environment to clarify the scope of the authorization and requested the DG Ports and Coasts to proceed to the restoration of the first 100-150 meters of beach.
In spite of all these irregularities and the existence of an opposite report of the Demarcation of Coasts, the Autonomous Community, being General Director Jose Maria Bernabé, made deaf ears and resolved to authorize the work of earthworks and installation of greenhouses affecting the DPMT protection easements.
ANSE then denounced that CARM favored the interests of Perichan SL and filed an appeal for relief that received no response from the Autonomous Community.
Thus while the demarcation of Costas sanctioned the works, the Autonomous Community favored its advance, which led to the Central Administration to file an appeal of elevation that has now been estimated by the TSJ.
In short, the Association considers that the ruling gives reason to the Central Administration and the association that always defended the legality, leaving in evidence that the Autonomous Community maneuvered to favor the private interests of Perichan to the detriment of the protection of the Coast and the environment.
For all of the above, ANSE considers that the immediate restitution of the coast affected by the removals and movements of lands should be proceeded, and it should be investigated if there was criminal responsibility on the part of the responsible ones of the Autonomous Community that authorized the works.
